Elly Rise Terms of Use

1. Acceptance of These Terms

These Terms of Use govern your access to and use of the Elly Rise website, the Elly Rise iOS application, and related services we provide. By accessing or using Elly Rise, you agree to these Terms.

If you do not agree to these Terms, do not use the website or app.

2. What Elly Rise Is

Elly Rise is a journaling and reflection tool intended to help users track stiffness, pain, flares, fatigue, related symptoms, and patterns over time. It is designed to support self-observation and help users prepare for care conversations.

• Elly Rise is not a medical device.
• Elly Rise does not provide diagnosis, treatment, emergency guidance, or clinical decision-making.
• AI-generated outputs, trend summaries, and reports are informational and observational only.

3. No Medical Advice

The app, website, reports, AI outputs, citations, trend summaries, symptom pattern descriptions, and other content provided through Elly Rise are not medical advice and should not be relied on as a substitute for professional medical judgment.

Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition, symptoms, treatment decisions, or changes in your health.

• Do not use Elly Rise for emergencies.
• Do not delay seeking professional care because of information presented in Elly Rise.
• Do not make treatment or medication decisions based solely on app outputs.

4. Eligibility and Personal Use

You may use Elly Rise only for lawful purposes and only in accordance with these Terms. The product is intended for your personal, non-commercial use unless we expressly agree otherwise in writing.

5. User Content and Your Responsibility

You are responsible for the information you choose to enter into Elly Rise, including notes, symptom details, medication names, and other journal entries.

• You should not upload unlawful, abusive, infringing, or misleading content.
• You are responsible for reviewing any reports or exported information before sharing them with a clinician or another person.
• You are responsible for maintaining access to your device and protecting it appropriately.

6. Premium Features and Subscriptions

Certain Elly Rise features are available only through a paid auto-renewable subscription.

• Subscriptions are billed by Apple through your Apple ID account.
• Subscription pricing, billing periods, and renewal terms are shown in the app before purchase.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period, subject to Apple's billing rules.
• You can manage or cancel your subscription through your Apple account settings.
• Refunds, billing disputes, and payment processing are generally handled by Apple in accordance with Apple's policies.

7. AI Features

Some Elly Rise features may use OpenAI as a third-party AI provider to generate optional summaries, note interpretations, trend alerts, visit briefs, or similar outputs. These features are optional and require your consent where applicable.

• When AI features are enabled, selected symptom logs, notes, recent journal context, medications you record, and weather context may be processed to generate the requested output.
• AI can make mistakes, omit context, or generate incomplete or inaccurate results.
• AI outputs should be treated as supportive product features, not as authoritative clinical guidance.
• We may change, suspend, or remove AI features at any time.

8. Website Features and Communications

If you use the Elly Rise website to join a waitlist, contact support, or otherwise communicate with us, you agree that we may respond using the contact information you provide.

9. Intellectual Property

Elly Rise and its related materials, including the app, website, branding, visual design, illustrations, text, graphics, software, and related content, are owned by Elly Rise or its licensors and are protected by intellectual property laws.

• You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from Elly Rise except as allowed by law or with our prior written permission.
• You may not use Elly Rise branding, logos, or content in a way that suggests endorsement, affiliation, or ownership without permission.

10. Acceptable Use

• Do not interfere with the operation or security of the app or website.
• Do not attempt unauthorized access to systems, accounts, APIs, or data.
• Do not use the service to transmit malicious code, spam, or unlawful content.
• Do not use automated tools to scrape or reproduce substantial portions of the website or app content without permission.

11. Availability and Changes

We may update, improve, suspend, or discontinue any part of Elly Rise at any time, including features, pricing, integrations, and content. We do not guarantee that any feature will always be available or that the product will always operate without interruption or error.

12. Third-Party Services

Elly Rise may rely on third-party services, including Apple, OpenAI, RevenueCat, SendGrid, Google Analytics, and other infrastructure providers. We are not responsible for the independent terms, policies, or operational decisions of those third parties.

13. Termination

We may suspend or terminate access to the website or app if we believe you have violated these Terms, misused the service, created risk for other users, or engaged in unlawful activity. You may stop using Elly Rise at any time.

14. Disclaimers

To the maximum extent permitted by law, Elly Rise is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

15. Limitation of Liability

To the maximum extent permitted by law, Elly Rise and its affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to your use of Elly Rise.

Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.

16. Indemnity

You agree to indemnify and hold harmless Elly Rise and its affiliates, personnel, and service providers from claims, liabilities, damages, and expenses arising out of your misuse of the service, your violation of these Terms, or your violation of applicable law or the rights of another person.

17. Governing Law

These Terms are governed by the laws applicable in the jurisdiction from which Elly Rise operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

18. Changes to These Terms

We may revise these Terms from time to time. If we do, we will update the Last Updated date on this page. Continued use of Elly Rise after updated Terms become effective constitutes your acceptance of the revised Terms.
